"A consumer group has sued Apple Computer Inc., alleging the iPod nano player is defective because its screen is easily scratched and that the company is breaking its product warranty by charging $25 for replacements.

The lawsuit by the Los Angeles-based Foundation for Taxpayer and Consumer Rights claims the pencil-thin nano - introduced last fall - cannot endure normal use without getting scratched to the point where it becomes unusable. The suit contends the Cupertino-based iPod maker should warn users accordingly.

The suit, which was filed Thursday in San Mateo County Superior Court, demands that Apple recall or repair the defective products for free, or refund the purchase price to dissatisfied customers. It also asks that the Apple add scratching or cracking to its warranty coverage.

Apple spokesman Tom Neumayr declined to comment Friday, citing company policy regarding pending litigation. Apple has been hit with a string of consumer lawsuits over its widely popular iPod players. More than 30 million iPods were sold last year, bringing cumulative sales to 42 million units since the original product debuted in 2001."

Alright, another lawsuit! Let's jump on the greedy bandwagon and see how much juice, or money, we can squeeze from a plump Apple.

It's no wonder their MP3 players are so damn expensive, they're getting sued left and right, they've got to make up for the legal costs. =P

Thats why they have lawyers on staff. They are cheaper that way.

There are alot of frivolous lawsuits out there but Apple really does seem to be screwing their customers over in the long term. You have to pay ~65$ to get a replacement every two years when your battery wears down, and of course the screen is going to be scratched no matter what anti-scratching techniques they use on them.
When I was looking for an MP3 player to buy last week I decided to not get an iPod because of the battery issue. I went with the Zen Micro instead. It arrived from Newegg yesterday and I'm pretty impressed with it. It's tiny as hell and looks really cool. It comes with a pouch you can carry it in which is pretty nice. But I thought I'd make one of these things for it anyways:
